The family of the junior doctor raped and murdered at RG Kar Medical College and Hospital wants the high court to “expand the scope of the investigation” and include the “other accused” within the purview of the case.
“We want the investigating agency to consider the role of the other accused and submit a supplementary chargesheet against them. We hope that with the intervention of Calcutta High Court, things will move in the right direction. We want further investigation into the case,” said advocate Gargi Goswami, who is representing the deceased doctor’s family.
The bereaved family has filed a fresh petition before the high court seeking further investigation into the case and expressing “disappointment” at the CBI probe so far.
The CBI had arrested three persons in connection with the rape and murder but could chargesheet only one — Sanjay Roy, the prime accused.
The other two — Sandip Ghosh, former principal of RG Kar, and Abhijit Mondal, former officer-in-charge of Tala police station — obtained bail as they were not chargesheeted within 90 days of their arrests.
The court of Justice Tirthankar Ghosh, where the petition for further investigation was filed, instructed the CBI lawyer on Thursday to ask his client if they would submit a status report during the next hearing on Tuesday or 15 days later.
CBI officers said that though the RG Kar rape and murder case is being monitored by the Supreme Court and the central agency has submitted several status reports, there is no bar on them to submit a report in the high court.
The family’s lawyer, Goswami, said if the CBI submits a supplementary chargesheet against Ghosh and Mandal, the two accused would undergo a fresh trial and the witnesses named in the trial of the main accused can be
re-examined.
“If there is a fresh trial, the same set of witnesses who have deposed in the trial against Sanjay Roy can be examined again and the number of witnesses can be increased,” said Goswami.
The petition submitted by the family mentioned their dissatisfaction over the CBI probe and raised questions about why several witnesses identified in the case had been left out of the trial.
The petition questioned why only two of the four junior doctors who were on duty with the victim on the night of the crime were made to depose during the trial.
The petition also questioned why the assistant superintendent (non-medical) of RG Kar who had called the family and said their daughter had committed suicide was not made an accused in the case.
A source close to the family said the CBI investigation has not addressed “multiple issues”. “Through the petition, we wanted to draw the court’s attention to these points. Further investigation can help us nail the other culprits,” said a family friend.
