The state government on Friday moved the high court seeking cancellation of bail granted to lawyer Tarit Sikdar, who had allegedly pushed and slapped an elderly person, causing his death, for taking too long to board his car on October 17.
A day after Sikdar’s arrest, the Alipore court granted him bail after around 30 lawyers appeared for him.
On Friday, following a plea by public prosecutor Saswata Gopal Mukherjee, Justice Joymalya Bagchi admitted the bail cancellation plea and posted the matter for hearing on November 20.
The victim, 65-year-old Ramesh Behl, ran a security agency in Beckbagan.
He was trying to get into his car in front of his Bhowanipore home when the man at the wheel of the car behind his started honking.
When Behl protested, the accused allegedly stepped out of the car, slapped and pushed the elderly man in a way that he fell and his head smashed against the footpath.
Behl’s driver had told the police that Sikdar had put the victim in his car but fled the moment he heard Behl’s son coming.
Sikdar has been charged under Indian Penal Code Section 304 (part II), which deals with causing culpable homicide not amounting to murder in which the accused has knowledge of consequences of the alleged offence. If convicted, the lawyer could be jailed for up to 10 years.
Behl’s daughter Pooja said she was hopeful that the high court would cancel the bail.
“Being a lawyer does not give one immunity against law. The police have been working hard on this case and we are confident the accused’s bail will be cancelled,” Pooja told Metro on Friday.
