Supreme Court stays Calcutta High Court judge’s directive

Justice Abhijit Gangopadhyay of Calcutta High Court directed the secretary general of the Supreme Court to produce before him by Friday midnight the translation of his television interview and the report on the matter, both of which had been placed before the Supreme Court earlier in the day.

However, a Supreme Court bench of Justice A.S. Bopanna and Justice Hima Kohli stayed Justice Gangopadhyay's directive to the secretary general.

"The order of present nature ought not to have been passed in judicial proceedings keeping in view the judicial discipline. We hereby stay the order passed by the high court judge in the suo moto proceedings. We direct, Secretary General of Supreme Court to communicate this order to the Registrar General of Calcutta High Court forthwith, who shall communicate the same to the High Court judge," the Supreme Court bench said in an order.

Solicitor general Tushar Mehta who appeared during the special hearing in the Supreme Court endorsed the court's view that Justice Gangopadhyay ought not to have passed such an order after the highest court of the country had pronounced a judgment.

In his order, Justice Gangopadhyay had said: "For the sake of transparency, I direct the Secretary General of the Hon'ble Supreme Court of India to produce before me the report and the official translation of the interview givenby me in media and theaffidavit of the Registrar General of this Court in original, forthwith by 12 midnight today."

The directive was issued after the Supreme Court asked the Acting Chief Justice of Calcutta High Court to shift cases concerning the teachers' recruitment "scam" from Justice Gangopadhyay to another judge.

While issuing the directive to the secretary general of the Supreme Court, Justice Gangopadhyay mentioned in the order that he would be waiting in his chamber till "12.15 in the midnight to get the said two sets in original which were placed before the Hon'ble Judges of the Supreme Court today".

After issuing his directive to the secretary general of the Supreme Court, Justice Gangopadhyay made a reference to Trinamul spokesperson Kunal Ghosh.

"My pranam to Trinamul Congress spokesman Kunal Ghosh. What he had said, has been proved true," the judge said. He then requested reporters present in the courtroom to convey his "pranam (salutation)" to Ghosh.

"If someone among you has contact with Kunal Ghosh, please convey my pranam to him," Justice Gangopadhyay said.

After Justice Gangopadhyay gave the CBI and the ED the liberty to interrogate Abhishek in the recruitment "scam" case, Ghosh told journalists that the Supreme Court would give justice.

While asking reporters to convey his regards to the Trinamul spokesperson, the judge said the prediction of Ghosh had come true.

Asked to react to the message that Justice Gangopadhyay wanted to be conveyed to him, Ghosh said: "I respect Justice Gangopadhyay and I convey my regards to him. I have immense respect and trust in the judicial system. I respect all judges."

Ghosh, however, said he felt some of Justice Gangopadhyay's observations and orders were deliberate.
