Calcutta High Court on Wednesday refused to allow BJP leader Suvendu Adhikari's plea to hold a four-day dharna with victims of alleged post-poll clashes in front of the main gate of Raj Bhavan from June 19.

Justice Amrita Sinha asked Adhikari to find a suitable venue for the dharna and fixed the matter for hearing on June 21.

In the same order, the judge asked state authorities to fix any other place for the BJP to hold its political programme.

Adhikari had moved the case against the decision of Kolkata police, which had turned down his prayer to allow his party's dharna in front of Raj Bhavan gates.

Moving the petition on behalf of Adhikari, lawyer Billwadal Bhattacharyya said: "The police had earlier allowed the ruling Trinamool Congress to hold a rally in front of Raj Bhawan gate. The law should be equal for all. So the decision of the police is not acceptable."

Bhattacharyya added: "The governor is the head of the state. So the party has the right to hold the rally in front of the governor's House. Moreover, post-poll clashes are now an admitted fact as the state through an affidavit before the court has stated that police registered FIRs of 107 post-poll clashes."

At that point, the judge asked Bhattacharyya: "But in front of Raj Bhavan? Only because the TMC had held a dharna there? It is an important thoroughfare. The road in front of Raj Bhavan should not be allowed to be obstructed."

Appearing for the state, advocate general Kishore Datta said the application through which the BJP leader approached police on June 13 was unacceptable. The party's main objective was to hold its event at the same venue where Trinamool organised its protest, he said. "Moreover, it was an administrative decision of the police not to allow the BJP to hold its programme," Datta added.

After hearing both sides, the judge asked Adhikari to find another venue and inform the court on Friday.

Last year, Trinamool leader Abhishek Banerjee held a dharna outside Raj Bhavan in a bid to force the Centre to release funds due to Bengal.

BJP worker death

Justice Amrita Sinha of Calcutta High Court on Wednesday directed Midnapore police to submit the inquiry report that Debra police station placed before the Midnapore magistrate court on the death of a BJP worker allegedly in police custody three days back. She also asked Debra OC to preserve the CCTV footage of the police station for now.

Justice Sinha asked the state authority to arrange a fresh post-mortem of the victim at SSKM Hospital and hand it over to the family. The case will again be heard in court next week. The order followed a family member alleging the BJP worker's death from police torture and seeking a central agency probe.
