Court must consider its limitations of authority, says Speaker

Calcutta High Court had asked Banerjee to reconsider a petition filed by Suvendu Adhikari seeking cancellation of Mukul Roy’s membership in the Assembly

Bengal Assembly Speaker Biman Banerjee on Monday said court would have to consider the limitations of its authority and judicial intervention in the activities of the Speaker was “unwanted”.

“The court must consider how much its authority is. Our court is intervening in the functions of the Assembly Speaker, which is unwanted,” Banerjee told journalists on the sidelines of an event at the Assembly.

He added that he had raised this issue at the All India Speakers’ Conference held in Assam recently.

Calcutta High Court had recently asked Banerjee to reconsider a petition filed by Opposition leader Suvendu Adhikari seeking cancellation of Mukul Roy’s membership in the Assembly. Roy, who had become an MLA on a BJP ticket, had defected to the Trinamul Congress. However, Banerjee had heard the case and found no reason to oust Roy. Adhikari had moved the court against the decision.

“The court has sent a reminder. I’ll see to it legally, how much of it can be accepted. I’ll call both the parties for hearing,” Banerjee said.

The Speaker also lashed out at governor Jagdeep Dhankhar for allegedly using the Assembly as a “political premises”. He said the governor must realise his boundaries.

“The governor must realise our constitutional convention. I have nothing new to say. He wanted to use the Assembly as a political premise. I had requested him to not hold a news conference here.... He should have considered the glory of the assembly,” Banerjee said.

Dhankhar had lashed out against the state government from the Assembly premises of April 14. He had dubbed Bengal as the “gas chamber of democracy”.

“Bengal is a gas chamber of democracy. People are being burnt to death. Then they are being given jobs.... Why are there so many questions regarding the CBI investigation? Crimes against women are on a rise,” Dhankhar had said.

Earlier in January, on National Voters’ Day, Dhankhar had come to garland the statue of Ambedkar in the Assembly and launched a diatribe against government officials as well as the Speaker.
