City top cop gets report on Governor Ananda Bose: Police may share findings with state govt, say sources

None of the 11 Raj Bhavan staff members summoned by the enquiry team co-operated with the police or appeared before them to record their statements, the sources said

The special enquiry team probing the allegations of sexual harassment against governor C.V. Ananda Bose, based on a general diary entry (GDE) at Hare Street police station, has submitted its initial report to Calcutta police commissioner Vineet Goyal.

Sources in the state home department said this was the initial report based on the findings till the submission of the report. There is scope for submission of a supplementary report if more facts emerge.

Senior officers at the Kolkata Police headquarters in Lalbazar were tight-lipped on the report’s contents.

The findings of the enquiry team are based on the statements of the 29-year-old Raj Bhavan staffer who lodged the police complaint, a Raj Bhavan staff member who came forward to help the woman and was later allegedly asked not to report for work and police officers who were the first to receive the woman complainant when she went to report the alleged offences on May 2.

None of the 11 Raj Bhavan staff members summoned by the enquiry team co-operated with the police or appeared before them to record their statements, the sources said.

CCTV footage, formally seized by the police from the PWD after the Raj Bhavan refused to part with it, is also part of the report, the sources said.

The woman had alleged on May 2 that the governor had touched her inappropriately first on April 24 and then again on May 2 on the pretext of offering her a promotion.

She reported the alleged harassment to the police on May 2.

Based on her complaint, a general diary entry was made at Hare Street police station. An FIR could not be registered because according to Article 361 of the Constitution, no criminal proceedings can be started against a governor.

A special team was formed to enquire about the allegations.

Sources in the state home department said the Kolkata Police brass could share the findings of the enquiry with the state administration. None of the senior police officers Metro spoke to said what the next course of action would be. Sources said the police were in the process of seeking legal opinion.

An officer said that according to the rule, the matter can be reported to the President of India, who is the appointing authority of the governor.

Text messages sent to the Kolkata Police commissioner seeking his reaction on the next course of action regarding the initial enquiry report did not yield any response till Monday night.

Sources in the state home department said this was “not the final report”. “A supplementary report can always be submitted if the summoned persons cooperate or if new evidence emerges. That can be annexed to this enquiry report,” a source in the home department said.

In a criminal case, a complainant often records her statement before the magistrate under Section 164 of the CrPC, which serves as evidence before a court of law. In this case, as no criminal case could be started, the woman’s statement was recorded by the police for “future action, as and when necessary”, the source said.
