Calcutta High Court Chief Justice T.S. Sivagnanam on Tuesday assigned a new division bench to dispose of the Bengal government's appeal for a stay on Justice Abhijit Gangopadhyay's order to the CBI and the Enforcement Directorate to probe alleged recruitment of nearly 5,000 employees to seven municipalities against payment of money.
The division bench headed by Justice Tapabrata Chakraborty is likely to hear the appeal within a couple of days, a high court source said.
While Justice Gangopadhyay was hearing cases related to the "scam" in the recruitment of school teachers and other employees, the ED's counsel had claimed that during a raid on the residence of Ayan Sil, an accused person in the case, documents showing alleged corruption in municipal appointments had been found.
The counsel requested the judge to give the agency and the CBI permission for initiating a separate case on the municipal recruitment. Accordingly, Justice Gangopadhyay granted the prayer on April 21.
The state government then prayed before Justice Amrita Sinha and then a vacation division bench of the high court for a stay on the operation of Justice Gangopadhyay's order, but failed to obtain an order in its favour.
The government later moved a division bench headed by the Chief Justice for the immediate hearing of the case and a stay on the order. But on Tuesday, Justice Sivagnanam assigned the matter for disposal to the division bench headed by Justice Chakraborty.
The state moved the Chief Justice's court on Tuesday after the Supreme Court had on Friday declined the urgent hearing of its appeal that challenged Justice Gangopadhyay's order.
