Justice Tirthankar Ghosh of Calcutta High Court said on Wednesday that he would hear on Monday Trinamul Congress leader Abhishek Banerjee's plea for quashing proceedings drawn up against him by the Enforcement Directorate (ED) in the alleged school recruitment scam.
When the ED's counsel S.V. Raju moved Justice Ghosh's court on Wednesday and demanded the early hearing of the appeal, the judge said he had many other cases to deal with. Justice Ghosh said Banerjee's plea could not be heard before Monday.
The judge hoped that the ED would not proceed in the case at least till the hearing. The ED counsel assured the judge that no step would be taken in the case till Monday.
After interrogating Kuntal Ghosh, who had been arrested in the teachers' recruitment "scam", the ED wanted to question Banerjee. The ED summoned Banerjee for questioning on July 3.
As the date for the panchayat poll was fixed on July 8 and Banerjee was busy with the campaign, he did not turn up for the interrogation and sought more time from the ED.
After the counting on July 11, Banerjee moved Justice Ghosh's court for quashing the ED's proceedings.
Primarily, Justice Ghosh declined to hear the case on personal grounds and sent the case back to the Chief Justice for reassignment.
On Tuesday evening, the Chief Justice again assigned the case to Justice Ghosh.
The ED had already attached the properties of Kuntal Ghosh and several others in the school recruitment "scam".
