Calcutta HC talks tough on Nawsad Siddique case

During previous hearing, division bench had ordered state to bring video footage and case dairy before court

Justice Debangshu Basak, the presiding judge of the division bench assigned to hear the bail plea by ISF MLA Nawsad Siddique on Wednesday, asked the state counsel how police concluded that all 88 arrested, including the MLA, were responsible for the January 21 attack on the cops.

The division bench headed by Justice Joymalya Bagchi had been hearing the case. But as the judge was out of town on Wednesday, the division bench of Justice Debangshu Basak was temporarily assigned to hear the case.

During a previous hearing, the division bench headed by Justice Bagchi had ordered the state to bring the video footage and case dairy before the court.

After seeing the video footage of Siddique’s speech, which the MLA had delivered on January 21, on his laptop on Wednesday, Justice Basak asked the state counsel: “Where is the proof that the MLA had instigated the supporters to attack police?”

The judge went on to ask the state how the police reached the conclusion that all the 88 ISF supporters, including Siddique, were involved in attacking the police.

“It is being claimed that they were seen in the footage. Some of them might be passers-by too,” the judge said.

The judge also questioned the lawyers appearing for Siddique and others.

The judge asked: “What will you do if the state can prove that the MLA had provoked his supporters?”

However, at the end of the hearing, Justice Basak did not pass any order.

As no order was passed by the bench, Siddique and his supporters will have to spend a few more days in jail.
