Calcutta High Court seeks NIA report on school firing probe

Justice Mantha had first handed over the case to NIA on March 15 but after the order was challenged by the state before the Chief Justice’s division bench, the bench upheld the order of the single judge bench

A Calcutta High Court division bench headed by Chief Justice T.S. Sivagnanam on Wednesday issued an order asking the NIA to file a report on the progress of its investigation into the incident of the death of two students of Dairivit High School in North Dinajpur during a clash in September 2018.

When the case came up for hearing on Thursday, the counsel appearing for the state informed the division bench on April 4 it had upheld the single bench order to hand over the case to the NIA.

On June 10 last year, two students - Rajesh Burman and Tapas Sarkar- of Darivit High School in North Dinajpur on September 20, 2018 were killed in a clash between two groups of people over appointment of a teacher in the local school.

The state had handed over the case to CID but as the members of both the families were not happy with the CID investigation, they moved the court of Justice Rajasekhar Mantha early last year.

Justice Mantha had first handed over the case to NIA on March 15 but after the order was challenged by the state before the Chief Justice’s division bench, the bench upheld the order of the single judge bench.

In the same order, the division bench had upheld another directive of Justice Mantha, who had ordered the state to pay adequate compensation to the families of both
the victims.

On Wednesday, the division bench asked to know from the state whether compensation has been paid to both the families,

The state counsel said that the government was ready to pay a compensation of Rs 2 lakh each to the both families, which they declined to receive.

At this the Chief Justice said: “Okay, the quantum of compensation will be decided by the court on the next hearing date in November.”
