Calcutta High Court on Wednesday declined to hear the "incomplete" defamation suit moved by governor C.V. Ananda Bose against chief minister Mamata Banerjee and some Trinamool Congress leaders on charges of maligning him publicly.
Justice Krishna Rao said since the case was based on media reports, the media concerned should be made parties.
"...otherwise, your petition will be incomplete," the judge remarked.
Moving the petition on behalf of the governor, advocate Dhiraj Trivedi alleged that the chief minister had been saying at public meetings that women were scared of visiting Raj Bhavan.
"Trinamool Congress spokesperson Kunal Ghosh used adverse words against the governor, while a newly elected MLA of the party, Sayantika Banerjee, refused to go to Raj Bhavan to take oath from the governor," Trivedi said.
The lawyer told the court that the governor had come to know about such remarks through the media.
After hearing Trivedi, Justice Rao said the plea was "incomplete" and advised the lawyer to file a fresh case, if he desired so.
The judge also asked the lawyer to make the media concerned parties in the case.
Later in the day, advocate Sanjay Basu, a lawyer known for his closeness to Trinamool, issued a press release saying they were aware of the defamation suit filed against the chief minister.
"We have come to know that a defamation suit has been filed against the CM
and others over alleged statements by the CM that women feel unsafe at Raj Bhavan. Given recent incidents where women have approached law enforcement agencies with allegations concerning Raj Bhavan, it would be a fair justification to state the agony of women, more so when the CM herself is a woman."
