The Supreme Court on Monday issued a notice to the Election Commission of India on a petition filed by the Sikkim Democratic Front challenging P.S. Tamang (Golay)’s appointment and continuation as chief minister and reduction of his disqualification term from six years to one year.

While seeking the EC’s response, a bench of Chief Justice N.V. Ramana and Justice Krishna Murari posted the matter for further hearing after six weeks.

Golay was convicted in a corruption case and was freed from prison after serving a year’s term on August 10, 2018. According to a section of the anti-corruption law, a person convicted of corruption cannot contest an election for six years from the date of his release from jail.

However, Golay, who had not contested the April 2019 Assembly elections won an bypoll held in October of the same year after the ECI reduced his disqualification period from six years.
