The Krishak Mukti Sangram Samiti on Wednesday said the Assam government was trying to get its leader Akhil Gogoi re-arrested through “false allegation” and “politically motivated” cases so that protests against the Citizenship Amendment Act (CAA) do not intensify again.

Akhil was arrested by National Investigation Agency (NIA) on December 17 last year. He was granted bail on Tuesday by the special NIA court, three months after he was arrested for his alleged role in anti-CAA protests and for allegedly having nexus with Maoists.

However, he is likely to be re-arrested, once he is released from Guwahati Central Jail, in another case filed by Sivasagar police.

“We were able to get bail for the NIA case. He was arrested in connection with another case of the crime branch and we have moved bail for that. There are several other cases against him in Upper Assam towns like Dibrugarh, Chabua, Lahowal, Sivasagar, Teok and Gaurisagar, for which he might be arrested, once he comes out after bail in the NIA case,” KMSS leader Bhasco De Saikia said here.

He alleged that Akhil was being arrested repeatedly in “fake”, “politically motivated” and “self-made” cases so the anti-CAA agitation does not intensify again.

Akhil’s lawyer Santanu Borthakur, while condemning the attempt to re-arrest Gogoi, said: “It is a politically motivated conspiracy. This attempt will violate Article 21 (right to liberty) of the Constitution. There are many Supreme Court rulings, which show that after getting bail, the accused should not be arrested. So I urge the state government to reconsider its plan.”

Leader of the Opposition Debabrata Saikia claimed these things portrayed the intolerance of the current government.

He told The Telegraph: “The government needs to stop such activities which gives an impression that it is intolerant or against fundamental rights.”

Senior PCC spokesperson Apurba Bhattacharjee said, “The proposed re-arrest of Akhil reflects the fascist nature of the government, which is trying to act above the law. We condemn this move and the atrocities of the government. “If Akhil is really guilty or is at fault, then why did the NIA fail to prove his alleged crime? The government should take initiatives to immediately release him,” he added.

Asom Jatiyatabadi Yuba Chatra Parishad general secretary Palash Changmai said the government was trying to weaken the protests by putting anti-CAA activists in jail. “We demand the government release Akhil immediately as the charges under which he was arrested could not be proved even after 90 days.”

“He is always released from jail as the allegations are not proved and because these are mostly false,” he added.
