A day after a division bench headed by Justice Soumen Sen declined to hear appeals against orders passed by Justice Abhijit Gangopadhyay in cases related to alleged irregularities in recruitment of teachers in primary schools, a division bench headed by Justice Tapobrata Chakrabarty was assigned the task.

A lawyer for candidates who were declared eligible in the 2014 TET (teachers’ eligibility test) but denied jobs because of the alleged irregularities moved the division bench headed by Justice Chakrabarty on Wednesday and pleaded for an early hearing.

Justice Chakrabarty said the appeals would be heard after the bench received the documents from the court of the bench headed by Justice Sen.

The change in the determination of the judges followed conflicting orders by the single-judge bench of Justice Gangopadhyay and the division bench headed by Justice Sen last week.

Justice Gangopadhyay had ordered a CBI probe following a PIL alleging that candidates had enrolled in the MBBS course in the reserved category last year based on fake caste certificates.

Justice Sen’s division bench stayed the inquiry but Justice Gangopadhyay
objected to that and issued another order countering the stay.

The matter has since been taken over by a constitution bench of the Supreme Court.

Chief Justice T.S. Sivagnanam of the high court on Tuesday issued an order changing the determination of Justice Gangopadhyay and transferring the cases related to primary education from his court to that of Justice Rajasekhar Mantha.
