A division bench headed by Justice Joymalya Bagchi on Thursday expressed dissatisfaction about the CBI investigation into the role of former West Bengal Board of Secondary Education (WBBSE) president Kalyanmoy Ganguly in the illegal job scam in schools.
“The CBI is claiming that the board president was the key person behind the illegal recruitments. According to norms, the board recruits the candidates whose names are recommended by the School Service Commission. What will the president will do if the SSC recommends the wrong persons?” asked Justice Bagchi.
The judge advised the CBI to approach to seek advice from Justice Abhijit Gangopadhyay of the same court.
During the bail hearing of Kalyanmoy Ganguly, Justice Bagchi wanted to know from the CBI counsel whether there was any substantial proof that points out that as the board chief, Ganguly had given jobs illegally in connivance with the then WBSSC chairman Subires Bhattacharyya.
The counsel’s reply failed to satisfy Justice Bagchi.
Justice Bagchi said that the CBI investigators were doing nothing and said: “Ask the officer supervising the investigation, to come to us.”
The judge postponed the hearing of the petition to January 4.
Job holders
In a related case, Justice Biswajit Bose of Calcutta High Court on Thursday asked the state school service commission, the board of secondary education and the CBI to submit the names of all 1,694 candidates who got appointments in Group D posts illegally. All the agencies have been told to file separate affidavits.
The judge asked the state education department to send copies of the list to each district inspector of the schools who would convey to the candidates the court order.
These candidates will have to resign from their posts with immediate effect. The next hearing is on January 24.
