The Supreme Court on Friday could not hear the case of two tribal women being paraded naked and sexually assaulted in violence-affected Manipur as Chief Justice D.Y. Chandrachud, heading the bench, was reportedly indisposed.

The matter in all likelihood will be heard on Monday if Justice Chandrachud recovers fully by that time, sources said.

On Thursday too, the Chief Justice of India’s bench had been cancelled owing to the indisposition of Justice Chandrachud. As a result, all important mentioning matters relating to urgent hearings were on Thursday and Friday listed before the second senior-most judge, Justice Sanjay Kishan Kaul.

On Friday morning, after finding that the CJI's bench had not assembled for the day, senior advocate Anand Grover rushed to the court of Justice Kaul seeking urgent listing of a petition filed by Hyderabad University professor Kham Khan Suan Hausing for quashing the FIR registered against him by Manipur police for his remarks against the Meitei community.

Grover told Justice Kaul, who was sitting in a bench with Justice Sudhanshu Dhulia, that the matter had been listed before the CJI's bench but since that bench was not sitting on Friday, it may be heard by the bench of Justice Kaul.

“Either your Lordships may take it up today or list it on Monday before the Chief Justice's bench,” Grover said.

“The matter will come up on Monday,” Justice Kaul said.

Hausing has challenged the FIR registered against him by the Manipur police and the subsequent summons issued by the chief judicial magistrate of Imphal against him for various offences under the IPC over his alleged remarks critical of the Meiteis in an interview to The Wire news portal.
