Kerala High Court grants bail to man accused of sexually abusing minor daughter

Man claims child made the story up because he had objected to her listening to the K-pop band BTS whose music he considers un-Islamic, and prevented her from going on a school trip

Kerala High Court has granted bail to a man accused of sexually abusing his minor daughter, who claims the child made the story up because he had objected to her listening to the K-pop band BTS whose music he considers un-Islamic, and prevented her from going on a school trip.

The 50-year-old father of two daughters and a son has been in judicial custody since December 6 after being arrested in Kasaragod. He is accused of sexually abusing his 14-year-old daughter, who has now moved in with her aunt on the orders of a family court.

The man, whose name has been withheld in the high court order, was accused of sexual abuse including inappropriately touching his minor daughter on several occasions.

The alleged incidents took place at his home as well as in Kochi, where the family had gone to see off the man’s son, who has moved to London for higher studies.

The girl told her aunt about the alleged assaults after her father refused her permission to go on a school trip to Wayanad.

"It is submitted that the allegations have been raised, primarily on account of the fact that the petitioner and his wife had objected to the victim following a Korean pop band known as BTS which according to the petitioner and his wife was un-islamic," Justice Gopinath P. stated in his order on Wednesday.

"It is submitted that the minor victim had started following the said band on the instigation of her aunt…. It is submitted that under the influence of aforesaid aunt and being aggrieved by the fact that the petitioner had not permitted the victim to go on a school trip to Wayanad (though the younger daughter of the petitioner was permitted to go), the victim had raised absolutely false allegations against the petitioner."

The court noted the argument of the accused that his wife and younger daughter continued to live with him.
