IAS officer to seek legal remedy for the EC's recommendation of disciplinary action after he was suspended for checking PM's helicopter

Mohammed Mohsin, the IAS officer who had been suspended for ordering the inspection of the Prime Minister’s helicopter, has said he will seek “legal remedy” to the Election Commission’s recommendation of disciplinary action against him.

On Thursday, the Central Administrative Tribunal had stayed the EC’s earlier order suspending him for ordering the checking of the Prime Minister’s helicopter in “violation” of norms for dealing with SPG protectees.

Mohsin, who had been posted as an election observer in Odisha, had been sent back to Karnataka.

After the CAT order, the EC withdrew the suspension but suggested to the Karnataka government that disciplinary action be taken against him.

Mohsin said in a media release on Friday: “In the night of 25 April, 2019, the commission has issued an order, inter alia, revoking the said order of suspension. It is also recommended, therein, to the government of Karnataka to initiate disciplinary action and I have been debarred from election duty until further orders. I will have to seek appropriate legal remedy against the latter part of the said order of April 25, 2019.”

He said it would not be appropriate to mention the merits of the case as it was sub judice.

The CAT had ordered the issuance of notice to the EC and “four others” and posted the matter for further hearing on June 6.

The tribunal had said the applicant, Mohsin, would be eligible to rejoin his former position under the Karnataka government “without any further ado about it”.
