The Supreme Court made it clear on Thursday it will not allow the stalling of the arbitral proceedings pending before the Singapore International Arbitration Centre pertaining to the ongoing legal tussle between US e-commerce major Amazon and Future Group, saying the sanctity of such proceedings needed to be maintained.
“The intention of your client (Future) is to defeat the arbitration. Your client is trying to stultify the order of the Supreme Court. As the Chief Justice of India, I am concerned with such practice. We will not let the arbitration proceedings be stultified. This is how the courts of the country will bring repute to the process,” Chief Justice of India D.Y. Chandrachud told senior advocate K.V. Viswanathan appearing for the group.
The bench which included Justice Hima Kohli and Justice J.B. Pardiwala made the observation after senior advocate Gopal Subramanium appearing for Amazon complained about Future Group’s bid to delay the arbitral proceeding before the Singapore tribunal.
Subramaniam was addressing the court during the morning mentioning time for the listing of Amazon’s application. The online retailer sought a direction to Future Retail Limited to abide by the apex court’s earlier order to resolve the dispute at the international tribunal.
He complained that the three-member tribunal had earlier on June 28 had dismissed the Future group’s plea to terminate the arbitral proceedings. The tribunal had fixed November 28 for the start of the arbitral proceedings.
However, the Future group chose to move Delhi High Court by filing a fresh petition challenging the tribunal’s order to dismiss its plea for termination of the arbitration proceedings.
